Terms & Conditions - the basics

No Duty to Act

Contacting RS Dalley, PLLC, Attorney Rannylin Stephanie Dalley or any employee, agent or representative of the Firm does not create any obligation on the part of the Firm to review, investigate, respond to or take action concerning your legal matter. The Firm has no duty to protect your interests, preserve a claim, make a filing, appear in a proceeding or take any other action unless and until the Firm has expressly agreed to represent you.

You should not assume that the Firm has accepted your matter merely because you have submitted information, spoken with an attorney or representative of the Firm or participated in an initial consultation.

Deadlines and Time-Sensitive Matters

Legal rights may be affected by statutes of limitations, filing deadlines, court dates, statutes of repose, notice requirements and other time limitations. Contacting the Firm does not suspend, extend or otherwise affect any applicable deadline.

Do not rely upon a website submission, voicemail, email or other communication to protect a legal right or satisfy a deadline. Unless the Firm has expressly agreed to represent you, you remain responsible for protecting your own legal rights and complying with all applicable deadlines.

No Guarantee That Communications Have Been Received

Transmission of a contact form, email, voicemail or other electronic communication does not guarantee that the communication has been received, reviewed or acted upon by RS Dalley, PLLC or Attorney Rannylin Stephanie Dalley. Technical problems, filtering systems, transmission failures or other circumstances may delay or prevent receipt of a communication.

If your matter involves an imminent court appearance, filing deadline, statute of limitations, emergency or other time-sensitive circumstance, you should not rely solely upon communication through this website.

Conflicts of Interest

The Firm must evaluate potential conflicts of interest before accepting a new representation. You should not send confidential or sensitive information concerning your matter until the Firm has determined that it is able to consider or undertake the representation.

Receipt of information from a prospective client does not prevent RS Dalley, PLLC or Attorney Rannylin Stephanie Dalley from representing another person in the same or a related matter where such representation is permitted by applicable law and the New York Rules of Professional Conduct.

Consultations Do Not Automatically Create Representation

An initial consultation, whether conducted in person, by telephone, by videoconference or through another means, does not necessarily establish an ongoing attorney-client relationship. A consultation may be conducted for the limited purpose of evaluating a potential matter, providing limited legal advice or determining whether the Firm is willing and able to undertake a representation.

Unless otherwise expressly agreed, RS Dalley, PLLC and Attorney Rannylin Stephanie Dalley have no continuing obligation to take action following a consultation. Where a written retainer or engagement agreement is required or contemplated, the scope of any attorney-client relationship will be governed by that agreement.

Scope of Representation

If the Firm accepts a matter, the attorney-client relationship extends only to the particular matter and scope of representation agreed upon between the client and the Firm. Representation concerning one legal matter does not mean that RS Dalley, PLLC or Attorney Rannylin Stephanie Dalley represents the client concerning other legal matters, proceedings, transactions, appeals or related issues unless the Firm separately agrees to undertake that representation.

No Tax, Financial or Other Professional Advice

Unless expressly agreed as part of a legal representation, information appearing on this website should not be construed as tax, accounting, investment, financial, medical or other non-legal professional advice. Estate planning, elder law, matrimonial matters, immigration matters and other legal issues may have financial, tax or other consequences requiring advice from an appropriately qualified professional.
